3. WHY DO WE PROCESS YOUR PERSONAL DATA?

4. WHAT MAKES THE PROCESSING OF YOUR PERSONAL DATA LEGITIMATE?

4.2 The processing of your personal data for the purposes described in clause 3.3 of this Cookie Policy is also necessary for TVH Equipment legitimate interests, which include:

4.3 The processing of your personal data for the purposes described in clause 3.4 is necessary to enable TVH Equipment to comply with its legal obligations.

5. WHO RECEIVES YOUR PERSONAL DATA?

However, in some instances, it may be inevitable for third parties to receive your personal data. Service providers who help us deliver the Website to you, and entities within the TVH Equipment group, may receive and process your personal data under certain circumstances.

Such external processors may only process your personal data on TVH Equipment behalf under explicit written instructions from TVH Equipment. 5.2 TVH Equipment may share your personal data with other entities within the TVH Equipment corporate group. However, we will ensure that all entities within the TVH Equipment group guarantee that all processing of your personal data complies with this Cookie Policy.

5.3 mateco does not send your personal data in an identifiable manner to any third party without your explicit consent. However, mateco may send anonymized and/or aggregated data to other organizations, which may use this data to improve products and services, as well as personalize the marketing, display, and sale of such goods and services.

6. DO WE TRANSFER YOUR PERSONAL DATA OUTSIDE THE EEA?

Yes, we transfer your personal data outside the EEA (i.e., the European Economic Area, which includes the EU, Norway, Liechtenstein, and Iceland). The parties to whom we transfer your personal data include entities within the TVH Equipment and foreign service providers.

6.1 mateco primarily processes your personal data within the EEA. However, to process your personal data for the purposes outlined in Article 3 above, we may also transfer it to other entities within the mateco group or to third parties processing the data on our behalf, located outside the EEA. Each entity outside the EEA that processes your personal data will be obligated to adhere to adequate security measures regarding the processing of your personal data. These security measures will result from:

  • the receiving country having laws in place that can be considered equivalent to the protection offered within the Estados Unidos Mexicanos; or
  • a contractual agreement between mateco and that entity. All mateco entities are parties to a contractual agreement based on the EC Standard Contractual Clauses (controller to controller) (Commission Decision C(2004)5721).

6.2 mateco may transfer anonymized and/or aggregated data to organizations outside the Estados Unidos Mexicanos. If such a transfer occurs, mateco will ensure that there are safeguards in place to guarantee the security and integrity of your data, as well as all rights with respect to personal data that you may enjoy under applicable mandatory law.

7. WHAT QUALITY ASSURANCES ARE IN PLACE REGARDING YOUR PERSONAL DATA?

We will not process more personal data than is necessary to achieve the purposes we have communicated. Additionally, we will only process your personal data for as long as necessary to fulfill the purposes we have communicated or until you withdraw your consent, provided that no other legal basis applies to justify the continued processing of your personal data. We also ensure that your personal data is kept secure.

7.1 mateco makes every effort to process only the personal data necessary to achieve the purposes described in Article 3.

7.2 Your personal data is only processed for as long as necessary to achieve the purposes described in Article 3 of this Cookie Policy or until you withdraw your consent to process them. Please note that withdrawing consent may result in you no longer being able to use all or part of the Website. mateco will de-identify your personal data when it is no longer needed for the purposes described in Article 3, unless there is:

  • a significant overriding interest of TVH Equipment, the payment service provider, or any other third party to maintain the identifiable nature of your personal data; or
  • a legal or regulatory obligation or a judicial or administrative order preventing TVH Equipment from de-identifying them.

7.3 TVH Equipment will take appropriate technical and organizational measures to keep your personal data safe from unauthorized access or theft, as well as accidental loss, tampering, or destruction. Access by TVH Equipment staff or its external processors will only occur to the extent necessary and will be subject to strict confidentiality obligations. However, you understand that security and protection are obligations that can never be fully guaranteed.

8. WHAT ARE YOUR RIGHTS UNDER THIS COOKIE POLICY?

As a data subject, you have several rights regarding the processing of your personal data. These rights include the right to access, rectify, withdraw previously given consent, erase, object to the processing of personal data, and receive your personal data from us in a structured, commonly used, and machine-readable format.

8.1 You have the right to request access to all personal data processed by TVH Equipment and that relates to you. TVH Equipment reserves the right to charge an administrative fee for multiple subsequent access requests clearly submitted to cause inconvenience or harm to TVH Equipment.

8.2 You have the right to request that any inaccurate personal data relating to you be corrected free of charge. If a correction request is submitted, such a request must be accompanied by proof of the inaccurate nature of the data.

8.3 You have the right to withdraw your previously given consent for processing your personal data.

8.4 You have the right to request the deletion of personal data relating to you if they are no longer necessary for the purposes described in Article 3 or if you withdraw your consent for processing them. However, you should be aware that TVH Equipment will evaluate a deletion request against:

  • overriding interests of TVH Equipment, your financial institution, the payment service provider, or any other third party;
  • legal or regulatory obligations or administrative or judicial orders that may contradict such deletion.

Instead of requesting deletion, you may also request that TVH Equipment limit the processing of your personal data if (a) you contest the accuracy of such data, (b) the processing is unlawful, or (c) the data is no longer necessary for the purposes described in Article 3 but are needed to defend yourself in legal proceedings.

8.5 You have the right to object to the processing of personal data if you can prove that there are serious and justified reasons related to your particular circumstances that justify such opposition. However, if the intended processing qualifies as direct marketing, you have the right to oppose such processing free of charge and without justification.

8.6 You have the right to receive from us, in a structured, commonly used, and machine-readable format, all personal data that you have provided to us.

8.7 If you wish to submit a request to exercise one or more of the rights described above, you may email info@mateco.mx . An email requesting to exercise a right shall not be interpreted as consent to the processing of your personal data beyond what is required to handle your request. Such a request must clearly state which right you wish to exercise and the reasons for it, if applicable. It must also be dated, signed, and accompanied by a digitally scanned copy of your valid ID card proving your identity. If you use the contact form, mateco may ask you to confirm your identity through a signature and proof of identity.

mateco will notify you promptly upon receiving such a request. If the request is valid, mateco will honor it as soon as reasonably possible and no later than thirty (30) days after receiving the request.
